Social Security Disability - What If My Claim Is Denied?
Don't give up! If your claim is denied and you still
believe that you are truly disabled, then you should appeal.
An appeal can be accomplished by following the directions set
forth in the denial notice. After a claim is initially denied
the first appeal is called a "Request for
Reconsideration." If the claim is denied at the
reconsideration level, the next appeal is called "A
Request for Hearing by Administrative Law Judge." If your
claim is denied by the administrative law judge, the next
appeal is to the Appeals Council and is called a "Request
for Review of Hearing Decision." You can file any of
these appeals in person at your local Social Security
Administration office, by telephone or by mail. There is a
60-day deadline to file each appeal. If the Appeals Council
denies your appeal, the next appeal must be filed in federal
court. You cannot skip any appeal level.
